General Terms and Conditions (GTC) for the Holokardio with AI project
§ 1 Scope of application and provider
(1) These General Terms and Conditions (GTC) apply to the use of the Holokardio project, in particular the digital product chatbot, on the website [your website].
(2) The provider and contractual partner is [Wilfried Jensen HoloKardio, [Bakadschik 5, 8730 Boyanovo Bulgaria], [wj@holokardio.info], hereinafter referred to as the "Provider".

§ 2 Service description
(1) HoloKardio offers the digital heart reflector that supports users in self-reflection and heart connectivity. It is based on AI technology that enables text, voice or mixed interactions.
(2) It can be used for reflection, inspiration and support in personal development processes.
(3) Additional functions include:

Access to individual call times with him.
Donations can be made to selected organisations as part of the payment.
§ 3 Conditions of use
(1) In order to use the chatbot, payment is required depending on the selected time period.
(2) The provider reserves the right to deny use in the event of misuse or violation of these GTC.

§ 4 Conclusion of contract and terms of payment
(1) With the payment (currently only via PayPal), the user submits a binding offer to conclude a contract.
(2) Payment is made via PayPal (currently only possible here) or other payment service providers provided by the supplier.
(3) Prices and payment models:

Basic functionalities of Noel.
One-off payment depending on the desired chat length Access to extended functions for a fixed duration.
Monthly subscription: (if available) ongoing use of the extended functions.
(4) EUR 2.50 of each payment is automatically forwarded to a donation organisation selected by the user.
§ 5 Digital content and right of cancellation
(1) Noel is a digital product that is provided immediately after purchase.
(2) In accordance with Section 356 (5) BGB, the right of cancellation expires as soon as the user expressly agrees that the execution of the contract begins before the expiry of the cancellation period and confirms that he loses his right of cancellation at the beginning of the execution.
(3) Repayments or refunds are excluded.

§ 6 Rights of use
(1) With the purchase, the user receives a non-transferable, non-exclusive right to use Noel.
(2) Any transfer, reproduction or commercial use of Noel without the express consent of the provider is prohibited.


§ 7 Donation function
(1) The donations are transferred to the organisation selected by the user.
(2) The provider assumes no liability for the use of the donations by the organisation.
(3) A donation receipt will not be issued by the provider.
(4) Publication of donation receipts:
The provider undertakes to publish the receipts for the donation transfers annually on a publicly accessible donation page on the platform. These receipts serve the purpose of transparency and contain only the transfer amounts and the name of the respective organisation, without disclosing personal data of the users.

§ 8 Exclusion of liability
(1) The provider accepts no responsibility for the results achieved by using the chatbot, as these depend on the individual requirements of the user.
(2) The provider is not liable for interruptions or technical problems that are beyond its control.

§ 9 Data protection
Personal data is processed in accordance with the [privacy policy](link to privacy policy). The user agrees to the processing of the data insofar as this is necessary for the provision of the service.

§ 10 Term and cancellation
(1) One-off payments provide access for the fixed duration of the contract.
(2) Subscriptions can be cancelled on a monthly basis. Cancellation must be submitted in writing or by e-mail at least 7 days before the next payment cycle.

§ 11 Changes to the GTC
(1) The provider reserves the right to amend these GTC. Users will be notified of any changes in good time.
(2) If the user does not object to the amended terms and conditions within 30 days, the amendments shall be deemed to have been accepted.

§ 12 Final provisions
(1) The law of the Federal Republic of Germany shall apply.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the provider.
